    Erudito Lyceum Privacy Policy

    This Privacy Policy (hereinafter – the Privacy Policy) explains how “Erudito Lyceum,” UAB, legal entity code 304228673, registered office and Vilnius branch address and contacts: Aguonų St. 26, LT-03212 Vilnius, Lithuania; tel. +37065788830, email vilnius@erudito.lt; Kaunas branch address and contacts: J. Gruodžio St. 9, Kaunas; tel. +37065788820, email info@erudito.lt (hereinafter – the Lyceum), as the controller of your personal data, processes your and/or your children’s/wards’ (hereinafter – Child) personal data when you and your Child visit and use the Lyceum’s website www.erudito.lt (hereinafter – the Website) as well as other services and platforms provided.

    When processing personal data, the Lyceum follows and complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter – GDPR), the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other applicable legal acts regulating personal data protection.

    If you use the Website, it means that you have read and become acquainted with this Privacy Policy and the purposes, methods, and procedures for processing your and/or your Child’s personal data specified herein.

    Please note that certain personal data of you and/or your Child, as specified in this Privacy Policy, are processed on the basis of your consent to the processing of personal data and/or on the basis of the Lyceum’s legitimate interest. Therefore, you have the right to withdraw such consent at any time, without affecting the lawfulness of data processing carried out on the basis of consent prior to its withdrawal, and/or to object to such use of your personal data.

    I. PRINCIPLES OF PERSONAL DATA PROCESSING

    When processing your and/or your Child’s personal data, we:

    • We will ensure that your and/or your Child’s personal data are processed in such a way that, by applying appropriate technical or organizational measures, proper security of personal data is guaranteed, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage.
    • we will comply with the requirements of applicable laws and regulations, including the GDPR;
    • we will process your and/or your Child’s personal data in a lawful, fair, and transparent manner;
    • we will collect your and/or your Child’s personal data for specified, clearly defined, and legitimate purposes and will not further process them in a manner incompatible with those purposes, except to the extent permitted by law;
    • we will take all reasonable measures to ensure that personal data that are inaccurate or incomplete, considering the purposes of their processing, are promptly corrected, supplemented, suspended from processing, or deleted;
    • we will keep them in a form that allows your and/or your Child’s identity to be determined no longer than is necessary for the purposes for which the personal data are processed;
    • we will not provide personal data to third parties or make them public, except in cases specified in the Privacy Policy or applicable laws;

    II. PROCESSING OF YOUR AND/OR YOUR CHILD’S PERSONAL DATA

    We inform you that the Lyceum processes the following personal data of you and/or your Child for the following purposes:

    1. For the purpose of registering and providing information about events/seminars/trainings/consultations:

    2. For the purpose of managing inquiries and optimizing communication:

Parents’/guardians’ relationship to the student(s), first and last name, email address, mobile phone numbers, consents to receive information about events and activities. Academic data of the student(s): language of instruction, previous schools, grades, certificates. Communication data: dates of emails/calls, content of correspondence. Behavioral and usage data: email open statistics, number of content clicks, responses to campaigns or other sent materials.

    Data processing periodThe data are processed and stored for 12 months, after which they are reviewed, and data collected for a specific purpose but no longer relevant are deleted.

    3. Evaluation of the Lyceum’s admission form:

    Parents’/guardians’ relationship to the student(s), first and last name, email address, mobile phone numbers, participation in events, communication records.
    Legal basis for data processingProcessing the data is necessary to take action at the request of the data subject before entering into a contract (GDPR Article 6(1)(b)).
    Data processing periodIf a contract is concluded, the data are stored for the duration of the contract and for 10 years after its expiration; if no contract is concluded, the data are deleted within 12 months.

    4. Conclusion and execution of the Lyceum’s educational services (pre-school, school, and non-formal) agreements and their annexes:

    We provide or transfer the dataTo IT service providers (individuals or companies performing computer equipment and network maintenance, video surveillance, access control and security alarm system administration and maintenance, server hosting, database administration functions), selected admission and education process platform providers, including but not limited to: ManageBac, OpenApply, Google Workspace for Education, digital tools (various educational programs and online platforms for learning and extracurricular activities), selected accounting and/or auditing companies and systems, legal service providers, individuals managing debts, supervisory, law enforcement, and other state institutions that receive data from us as required by law, the Ministry of Education, Science and Sports and its designated institutions, including but not limited to: the Student Register, NEMIS information system, the open Information, Consultation and Guidance System (AIKOS), Education Management Information System (ŠVIS), the National Examination Center Keltas (for children taking NMPP and PUPP), institutions cooperating with the school to ensure the child’s well-being at school – the Child Rights Protection and Adoption Service, case managers appointed by the Child Rights Protection and Adoption Service (commonly “SOS Children”), educational institutions (at the request of the student or their parents/guardians), Vilnius (SPIS system and svietimas.vilnius.lt system) and Kaunas city municipalities, Vilnius and Kaunas municipal public health offices (students’ self-care plans), non-formal education service providers, IBIS – International Baccalaureate system, Vilnius Pedagogical-Psychological Service (PPT), career planning and university application systems and universities – UBridge, UCAS, and The College Board.

    5. Organization and implementation of the educational process:

    Categories of dataPersonal data: First and last name, date of birth, personal identification number, address, phone number, gender, languages, nationality, ethnicity, copies of residence permit documents in Lithuania.
    Learning information: Schedules, attendance, educational outcomes (grades, comments), selected subjects, tests, exams, other project and creative assignments, learning analyses, task completion indicators, deadlines and submission status of assignments, certificates, dates and times of online class or meeting logins.
    Health information: Information provided in the health certificate, other information about the child’s health, illnesses (certificate date, physical education group, exemption from physical education classes and duration, recommendations), certificates from other educational institutions regarding exemption from physical education classes (attended institution, schedule, type of activity, number of hours), self-care plans.
    Contract information: Date and reason for termination of the education contract, school graduation date.
    Behavioral and social information: Feedback, data on cooperation with peers, behavioral data, compliance with school rules, details of social interactions, communication records.
    Activity information: Participation in extracurricular activities, attendance at events, activity priorities, awards and recognitions, participation in school and out-of-school activities, events, clubs, sports, and classes.
    Personal traits and plans: Hobbies, interests, expectations, planned future educational institution choices (universities, countries), learning experiences at the Lyceum.
    Parents’/guardians’ first and last name, email address, phone number.
    Legal basis for data processingProcessing the data is necessary for performing the contract (GDPR Article 6(1)(b)), complying with applicable legal requirements for the Lyceum (GDPR Article 6(1)(c) and GDPR Article 9(2)(b)), and based on the Lyceum’s legitimate interest in ensuring the quality of provided services (GDPR Article 6(1)(f)).

    6. Creation and implementation of children’s self-care plans

    Categories of dataFirst and last name, date of birth, residential address, class, plan creation date, plan adjustment date, parents’ (guardians’, caregivers’) first and last names, relationship, phone number, email address, school staff first and last names, positions, work schedule, diagnosis, international disease code, doctor’s conclusions, doctor’s recommendations, prescribed medications, medication instructions, possible allergic reactions, possible side effects, description of health condition, behavioral and emotional indicators, reactions when medication is taken or missed, environmental factors, factors helping to stabilize the condition, impact of health condition on the educational process, impact of health condition on out-of-school activities, physical activity tolerance, dietary characteristics, actions of teachers, actions of specialists (psychologist, VSS, social pedagogue), types of waste, waste storage containers, waste disposal frequency.

      Data processing periodThe data are stored for the duration of the Education Services Agreement, and the Child’s image is retained indefinitely according to the terms of the Education Services Agreement.

      8. For capturing Lyceum events (start-of-school-year celebrations, diploma ceremonies, etc.) for the purposes of community building and marketing:

      During public Lyceum events, in which you participate as a child’s parent or relative, photography and filming may take place. Since these events are public and you do not explicitly express your objection to being photographed or filmed during the event, you may be photographed or filmed, and your image may be published on the Lyceum’s Website, social media accounts, or community newsletters. If you notice your photo published on the Lyceum’s Website or social media accounts and object to it, please inform us using the Lyceum’s contact details provided above.

      9. Conclusion and performance of contracts with legal entities:

      III. CIRCUMSTANCES IN WHICH WE MAY TRANSFER YOUR PERSONAL DATA

      We inform you that we do not transfer or otherwise disclose your and/or your Child’s personal data to third parties, except in the cases specified below:

      1. If there is your request and/or consent;
      2. To data processors who process your and/or your Child’s personal data on our behalf and for the purposes specified by us and in this Privacy Policy (e.g., IT and server service providers, marketing service providers);
      3. To law enforcement and/or regulatory authorities, institutions, or other data recipients to whom data must be disclosed in accordance with legal requirements.

      In cases where the Lyceum transfers data to data processors, the Lyceum requires the data processors to process the transferred data exclusively according to the Lyceum’s instructions, for the purposes specified by the Lyceum, and in accordance with this Privacy Policy, the personal data protection laws, and the data processing agreements concluded between the Lyceum and the data processors.

      Based on a legitimate basis and purpose, the Lyceum may transfer your or your Child’s personal data to entities located outside the European Economic Area (EEA) (e.g., if the Lyceum’s data processors or personal data recipients are established outside the EEA). In cases where personal data are transferred from the EEA to countries not recognized by the European Commission as providing an adequate level of personal data protection, the Lyceum takes all appropriate measures to protect your and your Child’s personal data (e.g., by basing the data transfer on the European Commission’s approved standard contractual clauses).

      You and/or your Child, as data subjects, have the following rights:

      • The right to be informed about the Lyceum’s processing of personal data. You have the right to receive information about the personal data processed about you and/or your Child, the sources of the personal data, the purposes of processing, the legal basis, the retention period, and the recipients or processors of the data, as well as the rights of the data subject, and more.
        • The right to access the personal data about you and/or your Child processed by the Lyceum. You have the right to access the personal data about you and/or your Child being processed and to obtain a copy of them.
        • The right to request the correction of your personal data processed by the Lyceum. You have the right to request the correction of any inaccurate personal data about you and/or your Child processed by the Lyceum.
        • The right to withdraw consent. You have the right to withdraw your consent at any time without affecting the lawfulness of the data processing based on your consent before its withdrawal.
        • The right to request the deletion of data.         • The right to restrict data processing. You have the right to restrict the processing of your and/or your Child’s personal data by the Lyceum: (i) if you contest the accuracy of the data and the Lyceum is verifying it; (ii) if your personal data have been processed unlawfully, but you do not agree to their deletion; (iii) if your and/or your Child’s personal data are no longer necessary for the purpose for which they were collected, but are required by you to assert, exercise, or defend legal claims; or (iv) if you have objected to the processing, as described below, until it is verified whether the Lyceum’s legitimate grounds override your reasons.
        • The right to object to data processing. You have the right to object to the Lyceum processing your and/or your Child’s personal data for direct marketing purposes, and the right to object to the processing of your and/or your Child’s personal data based on public interest or the Lyceum’s legitimate interests, unless those interests override your and/or your Child’s reasons for objection.
        • The right to data portability of your personal data. You have the right to receive the personal data you have provided to us about you and/or your Child, or to request that these data be transmitted to another data controller in a structured, commonly used, and machine-readable format, if the processing of your and/or your Child’s personal data is based on your consent or our mutual contract and the data are processed by automated means.
        • The right to file a complaint. If you believe that your and/or your Child’s rights have been violated, you may contact the Lyceum by email at vilnius@erudito.lt (Vilnius branch) and/or info@erudito.lt (Kaunas branch), or you may submit a complaint to the State Data Protection Inspectorate (L. Sapiegos St. 17, LT-10312 Vilnius, email: ada@ada.lt).

        To exercise your rights, you can contact the Lyceum at the following e-mail address: vilnius@erudito.lt (Vilnius branch) and/or info@erudito.lt (Kaunas branch). Before exercising your right(s), the Lyceum may request that you provide proof of identity.

        The Lyceum hereby informs you that the exercise of the above-mentioned rights may depend on the specific conditions established by law. Therefore, if there are legally defined grounds, the Lyceum has the right to refuse your request to exercise a particular right in writing, providing justification.

        Upon receiving your request, the Lyceum undertakes to exercise your right as soon as possible, but in any case no later than one month from the date of receipt of your request, or to provide a written justification for refusing to comply. The Lyceum has the right to request a reasonable fee if your requests are clearly unfounded, repetitive, or excessive.

        V. ENSURING THE SECURITY OF YOUR PERSONAL DATA

        You are obliged to provide the Lyceum with accurate data and to keep your platform login details secure and confidential.

        The Lyceum processes your and/or your Child’s personal data responsibly and securely, in accordance with the personal data security requirements established by law. When implementing data processing measures and during the processing of data, the Lyceum applies the technical and organizational measures required by law to protect personal data from accidental or unlawful destruction, alteration, loss, disclosure, as well as from any other unlawful processing. The security measures and their level are determined based on the risks arising from the processing of personal data.

        Additionally, Lyceum employees who have access to personal data are familiarized with personal data protection requirements and ensure the full confidentiality of the processed personal data.
